UBER, LYFT and other Rideshare Companies are licensed and regulated by the California Public Utilities Commission (“CPUC”).
“As defined on CPUC’s website: Transportation Network Companies (TNCs) provide prearranged transportation services for compensation using an online-enabled application or platform (such as smart phone apps) to connect drivers using their personal vehicles with passengers. Insurance Coverage for Injuries sustained in UBER Accidents and LYFT Accidents
The California Public Utilities Commission (“CPUC”) has insurance requirements for all rideshare companies, including UBER and LYFT. The state of California requires that UBER and LYFT carry liability coverage for any of their drivers using the ride-sharing software. The insurance coverage varies depending on whether the UBER or LYFT driver is waiting on finding a passengers, has found a passenger or is transporting a passenger. The 3 periods are defined below:
“TNC services are defined by three periods:
Period 1: App open – waiting for a match.
Period 1– TNCs shall provide primary insurance in the amount of at least fifty thousand dollars ($50,000) for death and personal injury per person, one hundred thousand dollars ($100,000) for death and personal injury per incident, and thirty thousand dollars ($30,000) for property damage.
Period 2: Match accepted – but passenger not yet picked up (i.e. driver is on his/her way to pick up the passenger). …
Period 3: Passenger in the vehicle and until the passenger exits the vehicle.
