SCOOTER ACCIDENT – Do I have coverage if I was injured in a Scooter Accident?

July 30, 2019

Unfortunately electric scooter accidents are on the rise.  When San Diegans take to the roads on electric scooters they run the risk of being injured by an inattentive driver and falling victim to a scooter accident.  The most common question that arises after a scooter accident is: “Am I coverage for a scooter accident?”  Following a scooter accident the injured party will often look to their auto insurance for coverage.

Depending on who is at fault for the scooter accident, different types of insurance policies may provide coverage for injuries such as medical bills, loss of income, and/or property damage.  While there is no one clear answer, generally speaking uninsured/underinsured motorist (“UM/UIM”) coverage on an auto insurance policy covers an injured party in the event they are involved in a scooter accident with a car or motorist. Uninsured/underinsured motorist coverage is applicable because UM/UIM policies generally cover accidents involving the “use” of a motor vehicle, which applies to electric scooter accidents as long as a motor vehicle caused the accident. UM/UIM coverage is also “portable,” meaning that it attaches to you whether you are on an electric scooter, a pedestrian or in another’s car.
