Earlier this month our offices launched a new series of blogs focused on: “FAQs Car Accident” or “Frequently Asked Car Accident Questions”. One common question our San Diego Car Accident Attorneys frequently get include: What if the at-fault driver does not have insurance or leaves the scene before I receive their information.
In the event an at-fault driver flees the scene of a collision or does not have insurance coverage, this gives rise to a specific civil action, known as an uninsured motorist claim. In these types of car accidents, i.e., the at-fault driver flees the scene or does not have insurance coverage to cover the loss, the injured party can look to their own auto insurance policy. Specifically, if an injured party has Uninsured Motorist (UM) coverage, their sustained damages and personal injuries resulting in the collision can be covered. By filling a claim under your own Uninsured Motorist Coverage or UM policy, the process is the same as though you were filing a claim through an opposing insurance carrier. In other words you maintain the same burden of proof, specifically you must establish that (1) you were not at fault for the underlying collision and (2) the injuries you sustained as a result of the accident were actually and proximately caused by the car accident itself. While this seems simple on the surface the process can be challenging and tedious, as such, retaining a personal injury lawyer to represent you in your Uninsured Motorist claim would be advantageous to ensure that you receive fair and just compensation for your personal injuries.
