Business Fraud, Corporate Fraud and Investor Fraud can occur in any business dealings and in a variety of manners.  Fraud tends to be most prevalent during transactions, negotiations and the execution of agreements.  The most common basis for a fraud claim is when a party makes misrepresentations.

Fraud by misrepresentation takes one of two forms: (a) false statements made during contract negotiations and/or in the terms of the agreement; OR (b) omissions of material facts during contract negotiations and/or in the underlying agreement.

  • CONTRACT MISREPRESENTATION: Fraud by False Statements: Individuals and businesses enter agreements and execute contracts based on the statements made during contract negotiations and/or depending on the terms included in the underling agreement. If these statements and terms are false, this gives rise to a fraud claim that can be brought in California Superior Court or in Federal Courts depending on the situation.

 

  • CONTRACT MISREPRESENTATION: Fraud by Omission: As stated above contracts are executed based on representations made during negotiations or in the terms of the contract. If key material terms have been omitted or intentionally excluded from negotiations and the underlying agreement, this gives rise to a fraud claim that can be brought in California Superior Court or in Federal Courts depending on the situation.
