BUSINESS FRAUD I CORPORATE FRAUD – Payment From the Victims of Corporate Fraud Compensation Fund – VCFCF: Victims of Corporate Fraud Compensation Fund

The Victims of Corporate Fraud Compensation Fund “VCFCF” provides restitution to victims of corporate fraud who have otherwise been unable to collect on their judgment.  Corporate fraud for VCFCF purposes is fraud, misrepresentation, or deceit, made with intent to defraud, and involving a corporation.  Victims of Corporate Fraud are eligible to apply for payment from the Victims of Corporate Fraud Compensation Fund (VCFCF) after satisfying all the following conditions:

  1. Victims of Corporate Fraud Compensation Fundneed to have a final civil judgment, arbitration, or criminal restitution award based on fraud, deceit or misrepresentation. Requirement one:
    1. A final civil judgment, judgment based on an arbitration award, or a criminal restitution order against a corporation for fraud, misrepresentation, or deceit, made with intent to defraud; or
    2. A final criminal restitution order against a corporation’s officer or director for fraud, misrepresentation, or deceit, made with intent to defraud.
  2. The civil fraud judgment, judgment based on an arbitration award, or a criminal restitution order, came from a California court or a federal court sitting to conduct its affairs within the State of California.
  3. The fraud victim was a California resident at the time the fraud occurred.
  4. The fraud victim delivered the application to the California Secretary of State no more than 18 months after the judgment became final.Finality means the appeal period has expired.
  5. The corporation that committed the fraud must be a California corporation or a foreign corporation qualified to transact business in California.
  6. The Fraud victim must have diligently pursued collection efforts on assets of all judgment debtors and any other person who may have been liable to you for the fraud.
  7. The judgment debtor corporation, or defendant officer or director, has filed for bankruptcy, was the underlying judgment and debt declared nondischargeable and do you have the bankruptcy court’s permission to proceed with collection against the corporation.  Nondischargeable debtsare debts that have not been dissolved or forgiven in a bankruptcy proceeding.
