PRESCRIPTION ERROR CASE

Back in 2016, our client, Jane Doe, pregnant at the time, was diagnosed with preeclampsia and prescribed 400 mg of Labetalol. The dispensing pharmacy that filled the prescription, made a prescription error and dispersed the wrong dose. The pharmacy filled the prescription for 100 mg as opposed to the prescribed 400 mg. As a result of this prescription error and pharmacy malpractice, Jane Doe’s preeclampsia was not controlled, and her blood pressure rose to light-threatening levels. The Pharmacy error caused Jane Doe to be rushed to the emergency room where she had a premature delivery and her baby weighed less than three pounds. Our client underwent significant trauma and emotional distress as a result of the pharmacy error. Within a year of formally filing the pharmacy malpractice case in state court, the parties settled the case at mediation for $200,000 (Two Hundred Thousand Dollars).
