In short, there is no exact timeframe where a contingency attorney or personal injury attorney can confirm that your personal injury claim will be resolved or settled. Personal injury claims including car accident cases can take anywhere from a couple of months to a couple years to resolve. While there is no guaranteed timeframe to resolve a car accident case, there are several factors which will help expedite or prolong the resolution a personal injury claim. Relevant factors include:

  • The length and extent of the medical care and treatment involved. The more extensive the medical treatment is for the personal injuries sustained in a car accident or slip and fall claim, the more likely settlement and compensation will be delayed.
  • The severity of the injuries sustained will impact the length of time it will take to resolve a personal injury claim. However, when damages and liability are in dispute, the insurance carrier will delay engaging in settlement and negotiations.
  • If a complaint must be filed and a court case is otherwise initiated, then settlement and claim resolution will be delayed. Not all cases settle, sometime liability and damages are in such dispute that a personal injury case must be tried in court. Court cases take a long time to reach a verdict often two to three years. In general, legal proceedings delay resolution.
  • Additional factors which contribute to the length of time it will take for a personal injury claim to settle include:
    • Severity of personal injuries sustained
    • Consistency with the property damage and alleged bodily injuries
    • Number of claimants making personal injury claims
    • Number of parties involved in the car accident
    • Number of potential defendants
    • Ongoing investigations into the incident giving rise to the personal injury claim
    • Whether there is additional insurance coverage or policies to pursue
