BUSINESS FRAUD I CORPORATE SOCIAL RESPONSIBILITY – Fraudulent Misrepresentation and Corporate Social Responsibility of KIND Nutritional Bars

May 23, 2019

KIND, LLC the creators of “healthy” snacks and bars have represented this to be their corporate mission.  However back in March 2015, KIND, LLC’s corporate social responsibility was put into question. The FDA sent KIND a warning letter: https://www.fda.gov/ICECI/EnforcementActions/WarningLetters/ucm440942.htm. In short the warning letter advised that KIND, LLC has engaged in illegal marketing practices and other fraudulent actions; specifically questioning nutritional labels and the marketing of KIND products.

The FDA’s warning letter came at a time in which labeling guidelines were struggling to keep pace in an evolving food system and consumers have increased demand for transparency and corporate responsibility. In response to the FDA warning letter, KIND denied making fraudulent representations and indirectly defended their commitment to corporate social responsibility: “While we’ve made strides toward positive change on the policy and consumer education fronts, our work remains far from done,” – Lubetzky, CEO of KIND, LLC. https://www.kindsnacks.com/media-center/press-releases/fda-reverses-stance.html
